{"id":186,"date":"2015-04-16T02:45:30","date_gmt":"2015-04-16T02:45:30","guid":{"rendered":"https:\/\/nicolasrmunoz.com\/?p=186"},"modified":"2016-07-21T21:00:40","modified_gmt":"2016-07-21T15:00:40","slug":"las-10-reformas-laborales-que-el-empresario-debe-conocer","status":"publish","type":"post","link":"https:\/\/nicolasrmunoz.com\/?p=186","title":{"rendered":"Las 10 reformas laborales que el empresario debe conocer"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Con la aprobaci\u00f3n por parte de la Asamblea Nacional ecuatoriana de la Ley Para la Justicia Laboral y Reconocimiento del Trabajo en el Hogar, se modifican algunos aspectos del C\u00f3digo del Trabajo que afectan\u00a0al sector empresarial, siendo estos:<\/span><\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">1. Se <strong>elimina la figura de contrato a plazo fijo<\/strong>, por lo que, despu\u00e9s de cumplir el per\u00edodo de prueba (que se mantiene en 90 d\u00edas), el contrato se vuelve indefinido.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">2. Como consecuencia de lo anterior, el desahucio queda como una figura aplicable\u00a0\u00fanicamente para el trabajador, la misma que puede ser aplicada por este inclusive por medios electr\u00f3nicos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">3. En caso de terminaci\u00f3n del contrato de trabajo por acuerdo entre las partes, se deber\u00e1 pagar bonificaci\u00f3n de desahucio.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">4. Se <strong>crea el contrato por obra o servicio determinado dentro del giro del negocio<\/strong>, con el cual se podr\u00e1 contratar personal temporal para\u00a0obras o servicios especializados.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">5. Se establece la obligaci\u00f3n del empleador de llevar un registro de trabajadores que contenga: nombre, edad, procedencia, estado civil, clase de trabajo, remuneraciones, fecha de ingreso \/ salida, domicilio, correo electr\u00f3nico y cualquier informaci\u00f3n adicional que facilite su ubicaci\u00f3n.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">6. Se establece el criterio de participaci\u00f3n directa del 25% o m\u00e1s de\u00a0capital entre dos empresas para que estas se consideren vinculadas, lo que les har\u00eda subsidiariamente responsables en relaci\u00f3n a las obligaciones con los trabajadores.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">7.\u00a0<strong>D\u00e9cima tercera y d\u00e9cima cuarta remuneraci\u00f3n por regla general se mensualizan<\/strong>, pudiendo acumularse mediante solicitud por escrito del trabajador.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">8. Se establece\u00a0la <strong>facultad del\u00a0Ministerio rector de imponer\u00a0l\u00edmites a las remuneraciones<\/strong> de altos directivos en relaci\u00f3n a las remuneraciones m\u00e1s bajas recibidas dentro de la misma empresa, se\u00f1alando que, en caso de que una remuneraci\u00f3n supere dicho l\u00edmite, el exceso no ser\u00e1 deducible para efectos de Impuesto a la Renta.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">9. Se crea la figura de despido ineficaz a trabajadoras embarazadas y dirigentes sindicales, la que se aplicar\u00e1 de la siguiente manera: si se despide a un trabajador en esas circunstancias, este deber\u00e1 demandar el reintegro al trabajo, en caso de que la demanda sea concedida en sentencia, el empleado deber\u00e1 reincorporarse a trabajar con una bonificaci\u00f3n del 10% de la remuneraci\u00f3n que no recibi\u00f3 durante el tiempo que estuvo fuera de la empresa. En caso de que el trabajador gane el juicio pero no quiera reincorporarse a trabajar, se le pagar\u00e1 una bonificaci\u00f3n de despido (\u00faltimo sueldo por 3) m\u00e1s un a\u00f1o entero de sueldo.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">10.Se pone un <strong>techo a las utilidades<\/strong> de los trabajadores de 24 salarios b\u00e1sicos unificados (US$ 8.496,00 al 2015), debiendo entregar el sobrante al IESS.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Es importante conocer las reformas que la promulgaci\u00f3n de la mencionada Ley acarrear\u00e1n, se\u00f1alando que\u00a0se debe esperar la aprobaci\u00f3n por parte del Ejecutivo para que la Ley se publique en el Registro Oficial y por ende entre en vigencia, particular del que de seguro nos enteraremos, pues estar\u00e1 en todos los peri\u00f3dicos del pa\u00eds.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">\u00a0<\/span><\/p>\n<div><strong><a href=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1.jpg\"><img decoding=\"async\" class=\" wp-image-385 alignleft\" src=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-300x300.jpg\" alt=\"946191_10209443962761495_3977758748300464447_n-1\" width=\"162\" height=\"162\" srcset=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-300x300.jpg 300w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-150x150.jpg 150w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-768x768.jpg 768w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1.jpg 960w\" sizes=\"(max-width: 162px) 100vw, 162px\" \/><\/a>Nicol\u00e1s R.
