{"id":194,"date":"2015-05-27T14:26:38","date_gmt":"2015-05-27T14:26:38","guid":{"rendered":"https:\/\/nicolasrmunoz.com\/?p=194"},"modified":"2016-07-21T21:00:26","modified_gmt":"2016-07-21T15:00:26","slug":"nuevas-reglas-para-el-arriendo-de-inmuebles-en-ecuador","status":"publish","type":"post","link":"https:\/\/nicolasrmunoz.com\/?p=194","title":{"rendered":"Nuevas reglas para el arriendo de inmuebles en Ecuador."},"content":{"rendered":"<div><a href=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2015\/05\/Edificios-Cuenca.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-medium wp-image-195\" src=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2015\/05\/Edificios-Cuenca-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2015\/05\/Edificios-Cuenca-300x225.jpg 300w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2015\/05\/Edificios-Cuenca.jpg 1024w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2015\/05\/Edificios-Cuenca-980x735.jpg 980w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/div>\n<div><\/div>\n<div>Con la promulgaci\u00f3n del C\u00f3digo Org\u00e1nico General de Procesos (COGEP) el 22 de mayo de 2015, cambi\u00f3 enormemente la parte adjetiva (procesal) del entorno jur\u00eddico ecuatoriano, cuerpo legal que si bien acorde a su Disposici\u00f3n Final Segunda se\u00f1ala que entrar\u00e1 en vigencia despu\u00e9s de 12 meses desde su promulgaci\u00f3n (22 de mayo de 2016) esa misma disposici\u00f3n establece que ser\u00e1n la excepci\u00f3n a esa regla general las normas que reforman el C\u00f3digo Org\u00e1nico de la Funci\u00f3n Judicial, la Ley Notarial y la Ley de Arbitraje y Mediaci\u00f3n, as\u00ed como aquellas normas que regulen per\u00edodos de abandono (ahora se declara en el t\u00e9rmino de 80 d\u00edas, ya no 18 meses), copias certificadas, registro de contratos de inquilinato y citaci\u00f3n, los cuales entrar\u00e1n en vigencia con la promulgaci\u00f3n del C\u00f3digo.<\/div>\n<div><\/div>\n<div>En este art\u00edculo haremos referencia \u00fanicamente a lo que ata\u00f1e a los contratos de inquilinato, se\u00f1alando la modificaci\u00f3n particular que sufri\u00f3 el registro del contrato de inquilinato, el cual, antes del COGEP deb\u00eda registrarse ante un Juez de Inquilinato cuando este supere los diez mil sucres mensuales (apreciaci\u00f3n econ\u00f3mica anacr\u00f3nica) dentro de los 30 d\u00edas siguientes a su celebraci\u00f3n; y que ahora ya no se registrar\u00e1n ante Juez de Inquilinato, sino ante un Notario P\u00fablico, y actualizando el monto m\u00ednimo de obligaci\u00f3n de registro al valor de 1 Salario B\u00e1sico Unificado SBU (US$ 354 al 2015).<\/div>\n<div><\/div>\n<div>Lo antes mencionado se complementa con la Reforma a la Ley Notarial, la cual en su art\u00edculo 18 referente a las atribuciones del Notario agrega como numeral 36 la de \u201cInscribir contratos de arrendamiento, cuyo canon exceda de un salario b\u00e1sico unificado del trabajador en general, para lo cual cada notar\u00eda llevar\u00e1 un archivo numerado y cronol\u00f3gico.\u00bb<\/div>\n<div><\/div>\n<div>Queda entonces en el aire \u00bfQu\u00e9 hacemos cuando el canon de arrendamiento es inferior a 1SBU?
