{"id":352,"date":"2016-02-24T17:25:03","date_gmt":"2016-02-24T17:25:03","guid":{"rendered":"https:\/\/nicolasrmunoz.com\/?p=352"},"modified":"2016-07-21T20:51:03","modified_gmt":"2016-07-21T14:51:03","slug":"reformas-laborales-2016-a-la-vista","status":"publish","type":"post","link":"https:\/\/nicolasrmunoz.com\/?p=352","title":{"rendered":"\u00a1Reformas Laborales 2016 a la vista!"},"content":{"rendered":"<div><a href=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/02\/macbook-336704_960_720.jpg\" rel=\"attachment wp-att-354\"><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-medium wp-image-354\" src=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/02\/macbook-336704_960_720-300x200.jpg\" alt=\"Imagen de:https:\/\/pixabay.com\/es\/macbook-port\u00e1til-oficina-en-casa-336704\/\" width=\"300\" height=\"200\" srcset=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/02\/macbook-336704_960_720-300x200.jpg 300w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/02\/macbook-336704_960_720-768x512.jpg 768w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/02\/macbook-336704_960_720.jpg 960w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/div>\n<div><\/div>\n<div>En la tarde del 23 de febrero de 2016, ha ingresado a la Asamblea Nacional el Proyecto de Ley Org\u00e1nica para la Optimizaci\u00f3n de la Jornada Laboral y Seguro de Desempleo, el cual ingresa con car\u00e1cter de econ\u00f3mico urgente, es decir, que debe ser discutido y resuelto\u00a0por la Asamblea en los pr\u00f3ximos 30 d\u00edas, siendo sus principales puntos los siguientes:<\/div>\n<div><strong>REFORMA LEY PASANTIAS EN EL SECTOR EMPRESARIAL.<\/strong><\/div>\n<div><span style=\"text-decoration: underline;\">a) Pasant\u00edas\u00a0<\/span><\/div>\n<div>-Estas ser\u00e1n reguladas por el organismo rector de la Educaci\u00f3n Superior.<\/div>\n<div>-No podr\u00e1n durar m\u00e1s de 6 meses.<\/div>\n<div>\n<div>-Podr\u00e1 acordarse la cancelaci\u00f3n de cualquier tipo de estipendio (Actualmente se debe pagar un monto no menor al SBU m\u00e1s beneficios de ley)<\/div>\n<div>-Siempre se deber\u00e1 afiliar al empleado al IESS, aportando el empresario sobre el equivalente a un salario b\u00e1sico unificado (SBU)<\/div>\n<\/div>\n<div><strong>REFORMAS AL C\u00d3DIGO DE TRABAJO.<\/strong><\/div>\n<div><span style=\"text-decoration: underline;\">a) Contrato trabajo juvenil<\/span><\/div>\n<div>-Contrato con personas entre 18 y 24 a\u00f1os en relaci\u00f3n de dependencia<\/div>\n<div>-El aporte al IESS lo cubrir\u00e1 el estado siempre que la remuneraci\u00f3n del empleado no supere los 2 SBU y que este tipo de contratos no sean mayores al 20% del total de la n\u00f3mina estable de la empresa.<\/div>\n<div>-Si el salario es superior a 2 SBU, la diferencia la asume el empleador.<\/div>\n<div><span style=\"text-decoration: underline;\">b) Disminuci\u00f3n de la jornada de trabajo<\/span><\/div>\n<div>-Se establece como un tema excepcional.<\/div>\n<div>-Necesita el consentimiento del trabajador.<\/div>\n<div>-Se puede disminuir la jornada de 40 a 30 horas semanales cumpliendo ciertas condiciones: 1) Autorizaci\u00f3n del Ministerio de Trabajo previa constataci\u00f3n de que la empresa ha diminuido sus ingresos. 2) La disminuci\u00f3n ser\u00e1 por m\u00e1ximo 6 meses con una pr\u00f3rroga de m\u00e1ximo de 6 meses m\u00e1s y puede solicitarse una sola vez por ejercicio econ\u00f3mico. 3) \u00a0La remuneraci\u00f3n ser\u00e1 en funci\u00f3n de lo efectivamente trabajado 4) Si se producen despidos, la autorizaci\u00f3n de disminuci\u00f3n ser\u00e1 revocada. 5) El pago del aporte al IESS permanecer\u00e1 sobre el total de la \u00faltima remuneraci\u00f3n antes de la disminuci\u00f3n. 6) Solo se podr\u00e1n repartir utilidades a accionistas si se paga la jornada laboral completa de 8 horas diarias.<\/div>\n<div><span style=\"text-decoration: underline;\">c) Jornada trabajo prolongada.\u00a0<\/span><\/div>\n<div>-Podr\u00e1 pactar por escrito acorde a la normativa que emita el Ministerio del Trabajo.<\/div>\n<div>-Se podr\u00e1 laborar en jornadas superiores a las 8 horas diarias siempre que no supere 40 horas a la semana, ni 10 horas diarias, pudiendo distribuir el horario en forma irregular en los 5 d\u00edas laborables de la semana. Cualquier hora adicional diaria o en fines de semana se pagar\u00e1 recargo.<\/div>\n<div><strong>REFORMA LEY DE SEGURIDAD SOCIAL.<\/strong><\/div>\n<div><span style=\"text-decoration: underline;\">a) Seguro de desempleo\u00a0<\/span><\/div>\n<div>-sustituir\u00e1 al fondo de cesant\u00eda.<\/div>\n<div>-Se aplica para personas que bajo relaci\u00f3n de dependencia han perdido sus ingresos por un cese temporal de las actividades productivos (creo que la Asamblea puede mejorar esta redacci\u00f3n)<\/div>\n<div>-Debe acreditar al menor 24 aportaciones acumuladas y no simult\u00e1neas en relaci\u00f3n de dependencia debiendo ser al menos las 6 \u00faltimas continuas e inmediatas a la contingencia.<\/div>\n<div>-Estar en situaci\u00f3n de desempleo por m\u00e1s de 60 d\u00edas.<\/div>\n<div>-Solicitar este seguro para que sea pagado a partir del d\u00eda 61 de encontrarse desempleado.<\/div>\n<div>-No ser jubilado.<\/div>\n<div>-Cumplir con dem\u00e1s condiciones que determine el Consejo Directivo del IESS.<\/div>\n<div>-No habr\u00e1 incrementos en las aportaciones, sino que se financiar\u00e1 con un porcentaje de los aportes actuales.<\/div>\n<div>-Se calcular\u00e1 en base a una formula determinada por la ley seg\u00fan los aportes del trabajador.<\/div>\n<div>-Tendra una duraci\u00f3n m\u00e1xima de 5 meses.<\/div>\n<div>-Terminar\u00e1 cuando el afiliado: a) Tenga trabajo nuevamente 2) Cumpla el per\u00edodo m\u00e1ximo de prestaci\u00f3n. 3) Determinen hechos fraudulentos 4) Muerte del titular.<\/div>\n<div>-Durante este per\u00edodo no se cubrir\u00e1n contingencias del seguro universal obligatorio, salvo que coticen de manera voluntaria.<\/div>\n<div>Como lo mencionamos, hay 30 d\u00edas para tramitar el proyecto, el cual despu\u00e9s de haber sido discutido por la Asamblea, deber\u00e1 ser aprobado por el Presidente de la Rep\u00fablica para posteriormente ser publicado en el Registro Oficial y entrar en vigencia, periodo en el que puede acontecer cualquier cambio, indicando nuevamente que este es un proyecto sujeto a modificaciones.<\/div>\n<div>\n<div><a href=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1.jpg\"><img decoding=\"async\" class=\" wp-image-385 alignleft\" src=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-300x300.jpg\" alt=\"946191_10209443962761495_3977758748300464447_n-1\" width=\"161\" height=\"161\" srcset=\"https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-300x300.jpg 300w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-150x150.jpg 150w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1-768x768.jpg 768w, https:\/\/nicolasrmunoz.com\/wp-content\/uploads\/2016\/06\/946191_10209443962761495_3977758748300464447_n-1.jpg 960w\" sizes=\"(max-width: 161px) 100vw, 161px\" \/><\/a><\/div>\n<div><\/div>\n<div><strong>Nicol\u00e1s R.
